Terms of service
1. Overview
These Terms of Service ("Terms") apply when you visit our online store or buy anything from it. The store is operated by NORDJORK ("NORDJÖRK," "we," "us," or "our"), based in Gunnison, Colorado, USA. "You" means anyone who visits the store or places an order.
By using the store or placing an order, you agree to these Terms. If you don't agree, please don't use the store.
These Terms work together with our other store policies, which are part of this agreement:
- Privacy Policy — how we collect and use your information
- Refund Policy — returns, exchanges, and refunds
- Shipping Policy — shipping options, costs, and delivery
If these Terms and one of those policies ever disagree on a specific topic, the policy written for that topic wins.
Our store is hosted by Shopify, which provides the online platform that lets us sell our products to you.
2. Using the Store
Age. To place an order, you must be at least the age of majority where you live, or be using the store with the permission and supervision of a parent or guardian.
Your account. If you create an account, please give us accurate information and keep it up to date. You're responsible for keeping your password private and for activity under your account. Let us know right away if you think someone has used your account without permission.
Fair use. Please use the store for lawful, personal shopping. You agree not to:
- Break any law while using the store
- Interfere with the store's operation or security, or try to access parts of it you aren't meant to
- Use bots, scrapers, or similar tools to copy content, prices, or product listings
- Impersonate anyone or give us false information
- Buy products to resell without a wholesale agreement with us (see Section 5)
We may suspend or close an account, or refuse service, if we believe these Terms have been broken.
3. Products, Orders, and Payment
Product details. We do our best to show our products accurately. Colors can look different from screen to screen, and because many of our goods are made in small batches, small variations can happen. Sizing information is a guide, not a guarantee of fit.
Availability and prices. Products, prices, and promotions can change or be discontinued at any time. Limited runs and collaborations may sell out without notice.
Orders. Placing an order is an offer to buy. We may limit quantities, or cancel an order, for example if an item is out of stock, a price or description was clearly listed in error, or we suspect fraud. If we cancel after you've been charged, we'll refund you in full to your original payment method.
Payment. Payments are processed securely through Shopify's checkout and its payment partners. We don't store your full card details. All prices are in local currency. Your bank may charge currency conversion or international fees, which are your responsibility.
Taxes and duties. Sales tax is calculated at checkout where required. International orders may be subject to import duties, taxes, or customs fees charged by the destination country. These are the buyer's responsibility.
Discount codes. Discount codes have the terms shown when they're offered, can't be exchanged for cash, and generally can't be combined unless we say so. We may end a promotion at any time.
Gift cards. NORDJÖRK e-gift cards can be used for purchases in our online store. They can't be redeemed for cash except where required by law. Gift cards do not expire. Please treat a gift card like cash: we can't replace one that is lost or used by someone else.
4. Shipping, Returns, and Refunds
Shipping. Shipping options, costs, and timing are described in our Shipping Policy. Once your order is handed to the carrier, delivery timing is in the carrier's hands. Risk of loss passes to you when the package is delivered to the address you provided.
Returns and refunds. Returns, exchanges, and refunds are handled under our Refund Policy, including which items are final sale and how to request an authorized return. Please contact us before sending anything back.
5. Product Use and Wholesale
Use our gear as intended. Cross-country skiing and other outdoor activities carry real risks, including falls, injury, and changing weather and snow conditions. Some of our products, such as ski poles and wax scrapers, are sports equipment. Please use them only for their intended purpose, follow any instructions or warnings provided, and check them for wear or damage before use. Novelty and lifestyle items (like drink belts and ski ties) are for fun and aren't safety equipment. You use all products at your own risk, to the extent the law allows.
Wholesale and retail partners. Purchases for resale are handled separately through our wholesale program at nordjorkwholesale.com and are covered by separate wholesale terms.
6. Our Designs, Your Feedback, and Other Sites
Our designs and brand. The NORDJÖRK name, logos, graphics, product designs, photos, and written content in our store belong to us or the people who licensed them to us. You're welcome to view and share our store for personal, non-commercial use. Please don't copy, sell, or use our designs or brand without our written permission.
Reviews and feedback. If you send us ideas, suggestions, reviews, or photos, you allow us to use them, including to improve our products or feature them in our store and social media, without paying you. Please only share content that you have the right to share and that isn't offensive or misleading.
Copyright concerns. If you believe something in our store infringes your copyright, email skadi@nordjork.com with a description of the work, where it appears in our store, and your contact information, and we'll look into it promptly.
Links to other sites. Our store may link to other websites, such as social media or partner sites. We don't control those sites and aren't responsible for their content or practices.
7. Disclaimers and Limits of Liability
Disclaimer. We work hard to keep the store running smoothly and its information accurate, but the store and its content are provided "as is" and "as available." To the extent the law allows, we don't promise the store will always be available, error-free, or free of harmful code, and we disclaim implied warranties such as merchantability and fitness for a particular purpose. Nothing in these Terms limits any rights you have under the Refund Policy or under consumer laws that can't be waived.
Limits of liability. To the extent the law allows, NORDJÖRK and its owners, team members, and partners won't be liable for indirect, incidental, special, or consequential damages, such as lost profits or data, arising from your use of the store or our products. Our total liability for any claim relating to an order is limited to the amount you paid for the product involved. Some places don't allow these limits, so they may not all apply to you.
Indemnity. If you break these Terms or the law while using our store, and that causes a claim against us, you agree to cover the reasonable costs, including legal fees, that result.
8. Disputes, Changes, and Contact
Let's talk first. If something goes wrong, please email us at skadi@nordjork.com with your name, order number, the issue, and what you'd like us to do. Most problems can be solved quickly this way. You agree to give us at least 30 days to try to resolve it informally before starting any formal claim.
Governing law. These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. If a dispute can't be resolved informally, it will be handled in the state courts of Gunnison County, Colorado, or the federal courts for the District of Colorado, except that either of us may bring an individual claim in small claims court where it qualifies.
Events beyond our control. We aren't responsible for delays or failures caused by things outside our reasonable control, such as severe weather, natural disasters, carrier or supplier delays, power or internet outages, or government actions.
Changes to these Terms. We may update these Terms from time to time. The "Last updated" date below shows when they last changed. Changes apply to orders placed after that date. Your continued use of the store means you accept the updated Terms.
General. If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a part of these Terms right away, we can still enforce it later. These Terms, together with the policies listed in Section 1, are the full agreement between you and us about the store.
